Challenging Breath Tests in Washington State

What you should know is that submitting to the breath test at the scene is voluntary.  But not submitting to the breath test at the station may result in a driver’s license suspension of one year.

As noted, although you may refuse a breath test, your license will automatically be suspended if you do.  If you have submitted to a breath test and have subsequently been charged with a DUI, you do have options.  We can challenge the breath test results, as well as the reasons that you were stopped, and the procedures that were used in your breath test.  If we are successful in suppressing evidence of your breath test, the prosecution has its work cut out it in court.
